Terms & Conditions

These Terms & Conditions apply when you use the Claire’s Customs website or purchase products from us.

Please read them before placing an order.

1. Who we are

References to “you” or “your” mean the person using our website or placing an order.

2. Our website

Our website allows customers to purchase personalised and non-personalised products including, depending on current availability, items such as mugs, clothing, photo slates, keepsakes and other custom products.

Products and services available may change over time.

We may update, suspend or withdraw products where reasonably necessary.

3. Product information

We take reasonable care to ensure descriptions, photographs, dimensions and other product information are accurate.

Images shown on the website are illustrative.

Colours may vary slightly because of differences between:

  • screens;
  • printers;
  • inks;
  • coatings;
  • fabrics;
  • natural materials; and
  • production processes.

Products manufactured from natural materials, including slate, may have natural variations in shape, surface texture, colour and edges.

These variations form part of the product and are not necessarily defects.

4. Personalised products

You are responsible for checking all information submitted for personalisation.

This includes:

  • names;
  • spelling;
  • punctuation;
  • dates;
  • photographs;
  • artwork;
  • colours;
  • wording;
  • positioning; and
  • other custom information.

Where a preview is provided, you should inspect it carefully before completing your purchase.

Submitting an order confirms that you want us to produce the product using the information supplied or approved by you.

5. Production checks

Where reasonably practical, we may review customer artwork for obvious production issues.

This might include checking:

  • whether an image is likely to print;
  • whether important content is outside the printable area;
  • whether artwork appears severely pixelated; or
  • whether the design presents an obvious production problem.

This is a production check rather than a proofreading service.

We are not responsible for identifying every spelling mistake, incorrect date, incorrect name or other error supplied by a customer.

6. Orders

When you place an order, you are making an offer to purchase the products shown in your order.

You will normally receive an electronic acknowledgement after placing the order.

A contract between you and Claire’s Customs is formed when we accept the order.

We reserve the right to decline or cancel an order before production where there is a legitimate reason to do so.

Examples may include:

  • inability to obtain required materials;
  • an obvious pricing error;
  • suspected fraud;
  • problems with customer artwork;
  • unlawful content;
  • suspected intellectual-property infringement;
  • technical errors;
  • inability to produce the requested item safely or to an acceptable standard.

If we cancel an order after taking payment and no goods are due to you, the relevant amount will be refunded.

7. Prices

The price payable is the price shown when you place your order, subject to correction of obvious errors.

Delivery charges and other applicable costs will be shown before you complete checkout.

Prices include applicable taxes where required.

If an obvious pricing or technical error occurs, we are not obliged to supply a product at an obviously incorrect price where you could reasonably have recognised the error.

8. Payment

Payment must normally be received before production begins.

Available payment methods are displayed during checkout.

Payments may be processed by independent payment service providers.

Claire’s Customs does not receive your full payment-card details where payment is handled directly by an external payment processor.

9. Discount codes and promotions

Discount codes are subject to any conditions stated with the promotion.

Unless stated otherwise:

  • promotional codes cannot be exchanged for cash;
  • only one promotional code may be used per order;
  • promotions cannot be applied retrospectively;
  • promotional discounts do not normally apply to delivery charges; and
  • promotions may be withdrawn or amended before an order is placed.

Your statutory rights are unaffected.

10. Production

Many Claire’s Customs products are individually made to order.

Production times may vary.

Where we need clarification or approval from you, we may pause production until you respond.

We are not responsible for a delay caused by waiting for information reasonably required from you.

11. Delivery

Delivery options, charges and estimates are described during checkout and in our Delivery & Returns Policy.

You are responsible for providing a complete and accurate delivery address.

Risk in the goods passes to you when the goods come into your physical possession or the possession of a person identified by you to receive them, subject to applicable law.

12. Personalised-product cancellations

Products made to your specifications or clearly personalised are generally excluded from the normal statutory online change-of-mind cancellation right.

We may nevertheless agree to cancel an order as a goodwill measure if you contact us before production has started.

Once production begins, cancellation of a personalised item may no longer be possible.

13. Non-personalised cancellations

Where statutory distance-selling cancellation rights apply to a non-personalised product, you may exercise those rights in accordance with applicable consumer law and our Delivery & Returns Policy.

14. Faulty goods

Nothing in these terms affects your statutory rights.

Goods must meet the standards required by applicable consumer law.

If a product is faulty, misdescribed or does not otherwise conform to the contract, remedies may include repair, replacement, price reduction or refund depending on the circumstances.

15. Customer artwork and intellectual property

When you upload or provide an image, photograph, logo, illustration, design, text or other material, you confirm that:

  • you own the material; or
  • you have permission or another lawful right to use it and authorise us to reproduce it for your order.

You retain ownership of rights you already hold in customer-supplied material.

You give Claire’s Customs a limited permission to copy, resize, crop, format, print and otherwise process the material only as reasonably necessary to provide your requested products and related customer service.

16. Third-party rights

You must not knowingly ask us to reproduce material in a way that infringes another person's copyright, trade mark, privacy or other rights.

Uploading an image from the internet does not necessarily mean that you have permission to reproduce it.

We may decline an order where we reasonably believe the requested reproduction could infringe third-party rights.

17. Unacceptable content

We may refuse to produce material that we reasonably believe is:

  • unlawful;
  • threatening;
  • seriously abusive or harassing;
  • defamatory;
  • sexually exploitative;
  • an unlawful intimate image;
  • content depicting child sexual abuse or exploitation;
  • terrorist or extremist material prohibited by law;
  • fraudulent;
  • likely to infringe third-party rights; or
  • otherwise unlawful for us to reproduce or supply.

The existence of this discretion does not mean that Claire’s Customs actively monitors or approves all customer-submitted material.

18. Customer photographs

Customer photographs are used to fulfil the customer's order and provide related services.

We will not use a private customer photograph to advertise Claire’s Customs simply because it was uploaded for an order.

If we would like to feature a customer's photograph or finished personalised product in marketing, we will obtain appropriate permission first.

19. Our designs and website content

Unless otherwise stated, the Claire’s Customs name, website design, original graphics, photographs, product mock-ups, copy and designs created by us remain owned by us or used under appropriate licence.

They must not be reproduced commercially without permission.

20. Website availability

We aim to keep the website available and functioning correctly but cannot guarantee uninterrupted operation.

We may temporarily suspend access for maintenance, security, upgrades or circumstances outside our reasonable control.

21. Accounts

If customer accounts are available, you are responsible for keeping your login information secure.

Please tell us promptly if you believe someone has gained unauthorised access to your account.

We may suspend an account where reasonably necessary to protect you, us or other users.

22. Events outside our reasonable control

We will not be responsible for a failure or delay caused by circumstances outside our reasonable control where the law permits.

Examples may include:

  • significant courier disruption;
  • severe weather;
  • fire;
  • flood;
  • power failure;
  • widespread telecommunications failure;
  • industrial action;
  • supplier disruption; or
  • other events that could not reasonably have been prevented.

We will take reasonable steps to minimise the effect on affected orders.

23. Liability

Nothing in these terms excludes or limits liability where it would be unlawful to do so.

In particular, nothing limits your statutory consumer rights or excludes liability that cannot lawfully be excluded.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses suffered by a consumer where permitted by law.

24. Privacy

We process personal information in accordance with our Privacy Policy.

25. Changes to these terms

We may update these terms when our products, website, business practices or applicable law change.

The terms applying to your purchase will normally be those in effect when your order is placed.

26. Governing law

If you are a consumer resident in the United Kingdom, these terms are governed by the applicable law of the part of the United Kingdom in which you live, and you retain any mandatory rights you have to bring proceedings in your local courts.

Nothing in this clause deprives you of mandatory consumer protection.

27. Complaints and contact

If something has gone wrong, please contact us first so that we have an opportunity to resolve the matter.
